Welcome to Nos Vigeo Inc., doing business as Vigeo Gardens ("Vigeo Gardens," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our services, including ordering fresh produce from Rubber City Farm via phone, SMS, email, or our website (e.g., rubbercityfarm.com). By placing an order or engaging with us, you agree to these Terms. Please read them carefully.

1. Services

We produce and deliver fresh, locally grown produce (e.g., greens, herbs) from Rubber City Farm in Akron, Ohio, to customers within a 300-mile radius. Orders are fulfilled based on availability and scheduling, on the scheduled delivery day.

2. Ordering Process

  • How to Order:

    • Phone: Call us at 330-362-8308.

    • SMS: Reply to our order prompts (e.g., “Hi [Name], ready to order? Reply with items”) or text us directly.

    • Email: Send orders to sales@vigeogardens.com.

    • Online: Via our website or customer portal (if available).

  • Order Deadlines: Orders must be received by Tuesday at 5 PM EST for processing, unless otherwise agreed.

  • Confirmation: We’ll confirm orders via phone, SMS, or email. Unconfirmed orders may not be fulfilled.

3. Pricing and Payment

  • Pricing: Listed on our website or provided upon request. Prices may change without notice, but confirmed orders lock in the quoted rate.

  • Payment Terms: Due upon delivery (COD) or net 30 days for approved accounts, processed via Zoho Books. Late payments incur a 1.5% monthly fee.

  • Taxes: You’re responsible for applicable sales taxes unless exempt (provide documentation).

4. Delivery

  • Schedule: Deliveries occur on the scheduled delivery day, within our 300-mile radius, barring unforeseen delays (e.g., weather).

  • Risk of Loss: Transfers to you upon delivery. Inspect produce immediately—report issues within 24 hours.

  • Returns: Perishable goods are non-returnable unless defective or incorrect. Contact us within 24 hours for replacements or credits.

5. SMS Communications

  • Opt-In: By texting “YES” or providing your number, you agree to receive order-related SMS (e.g., prompts, confirmations).

  • Opt-Out: Text “STOP” to unsubscribe. We’ll cease non-essential messages, though transactional texts (e.g., delivery updates) may continue.

  • Costs: Standard messaging rates may apply per your carrier.

6. Eligibility

Our services are for businesses (e.g., restaurants, hotels) and individuals 18+. You represent that your information is accurate and you’re authorized to order.

7. Cancellations and Changes

  • Cancel or modify orders by contacting us before fulfillment begins (typically Tuesday 5 PM EST). Late changes may not be accommodated.

8. Limitation of Liability

  • We’re not liable for indirect damages (e.g., lost profits) or delays beyond our control (e.g., natural disasters). Our liability is limited to the order value.

  • Produce is provided “as is”—we strive for quality but don’t guarantee perfection due to its perishable nature.

9. Intellectual Property

Our website, logos, and brand (e.g., “VIGEO GARDENS”) are ours. You may not use them without written consent.

10. Termination

We may refuse service or cancel orders for any reason, including non-payment or violation of these Terms, with notice where feasible.

11. Governing Law

These Terms are governed by Ohio law. Disputes will be resolved in Summit County, Ohio courts, unless otherwise required.

12. Changes to Terms

We may update these Terms. Check this page for the latest version (see “Last Updated” date). Continued use after changes means you accept them.
